Service description
1.1Massoon offers an online booking service (Services) that puts Behandelingen independent independent massage  therapists  (Therapists)  in contact with consumers (customers  or you) who want to buy and/or receive  massage  and/or  therapy treatments. 
1.2When delivering the service, Massoon provides a platform to connect with customers. You acknowledge that  Massoon  is not responsible for treatments booked through the Service.
1.3As a user of the Service, you agree to provide us with complete and accurate information and update such information to keep it accurate, up-to-date and complete. You understand that any personal information you provide will be handled in accordance with Massoon’s privacy policy available on  Massoon.net/legal/privacy..net/legal/privacy.
1.4These are the terms and conditions that apply to your use of our website www. Massoon.net  and any other website owned and operated by us (website), service and all our software, including all mobile  Massoonapplications (apps). The service is accessible via both the website and the app.
Why you should read them
1.5These conditions create a legally binding agreement between you and us. By accessing or using the Service, Website and/or App, you accept Voorwaarden these terms and conditions and agree to use the Service, Website and/or App in accordance with these Terms and Conditions.
1.6As a condition of your use of the Service, Website and/or App, you guarantee that you are 18 years of age or older and have the right, authority and capacity to enter into these terms or, if you are between 13 and 17 years old, have received permission from your parent or legal guardian. If you are under the age of 13, it is forbidden to use the Service, Website and/or App.

2.3If we need to contact you, we will do so by phone or by writing to you at the email address or mailing address you provided us when creating your account in accordance with Clause 4.
“Writing”  includes emails
2.4When we use the words ” write  ” or “written ”  geschreven in these terms, this also includes emails.
3.Our contract with you
By creating your account in accordance with Clause 4, you acknowledge that:
3.1there is a contract between you and us regarding your use of the Service, Website and/or App and you agree to be bound by these Terms and Conditions regarding your use of the Service, Website and/or App. You acknowledge that we are not responsible for treatments booked through the service;
3.2The contract for the delivery of treatment to you by the therapist is strictly between you and the therapist. This means that it is the therapist (not us) who is legally responsible for providing the treatment to you. However, we remain responsible for our obligations to you in accordance with these conditions, which are legally binding; And
3.3we cannot guarantee uninterrupted access to the Service, Website and/or App, or the sites to which they link, and you agree that we are not responsible for any damage, claims or otherwise that result directly or indirectly from intermittent access to the Service, Website and/or App.
4.Create your account
4.1To access certain features of the Website and/or App and to use the Service, you must log in to www.massoon.net/hotel or use the hotel’s QR code
4.2To make your booking, you must provide us with the following information:
4.2.1email address;
4.2.2name;
4.2.3hotelkamernummer
4.2.4Possibly thef acturation address; and
4.2.5Phone number.
5.Reservation
5.1In order to book a treatment, you need to make a number of choices (see all points 5.2)
5.2.1choose whether you prefer a male or female therapist;
5.2.2choose the date and time you want to undergo the treatment;
5.2.3choose the type and duration of treatment you wish to receive; And
5.2.4specify the location (room number or spa space present)  where you want your treatment
5.3Before you make your booking, we will provide you with technical means in the form of a standard check for completeness and plausibility (make sure all the required fields have been filled in and that the entered characters are suitable for the relevant required field) to help you identify any errors you have made in your input. Your booking details will then be summarized again so that you can check them.
5.4We offer payment by credit or debit card.
5.5Your payment details will be requested when you make your first booking and the payment for the applicable treatment will be collected as soon as you confirm your booking.
5.6The contract for a treatment is concluded at the time the credit card is taxed or the debit card is debited. Upon confirmation of the successful payment, we will provide you electronically with the details of the treatment you booked and information about the therapist who will provide the treatment.
5.7By providing us with your payment information, you agree that for all further bookings you make, our third-party payment processor Stripe (payment processor) is authorized to immediately defer from your account for all applicable fees and charges related to such a booking and that no additional notice or consent is required. You agree to notify us immediately of any change in your payment information. We reserve the right to change the price of a Treatment at any time and how we will charge you for such treatment. This does not apply to a Treatment that has been posted prior to such a price change.
5.8Any dispute over any of our costs must be reported to us through support@massoon.nl..
5.9The reimbursement for the treatment is paid to the therapist who gives the treatment. For each booking made through the service, we charge the therapist a commission. We have an agreement with the therapist that gives us the right to deduct the commission from the amount you paid to our payment processor for the treatment.
5.10By booking a Treatment through the Service, you acknowledge that the delivery of the Treatment will be subject to the therapist’s method and guidelines.   We are not a party to such conditions and have no responsibility to you or the therapist regarding the delivery of the treatment.
5.11It is your responsibility to provide complete and accurate information at the time you book a treatment. Failure to provide complete and accurate information may result in a rejection of your booking, cancellation of your booking or the inability of the booked therapist to provide the treatment as requested.
5.12If a booking has been made by or for a person between the ages of 13 and 17, you acknowledge and agree that that person’s parent or legal guardian will be present during the treatment.
5.13The languages available for making a booking are German,  English  and French
5.14The contract text of a booking is saved.
6.Payments, cancellation and rescheding
6.1The price of the Treatment is the price indicated on the booking page when you book a Treatment, including all taxes and other fees, if applicable. You must pay the  Treatment at the time of booking in accordance with clause 5.
6.2It is always possible that, despite our best efforts, some treatments are mispriced. Normally, we will check prices before accepting your booking, so that if the correct price on your booking date is lower than the listed price on your booking date, we will charge the lower amount. If the correct price on your booking date is higher than the price listed to you, we will charge the lower amount listed.
6.3You agree to the cancellation and resy scheduling policies below and associated costs and  payments
6.3.1You can cancel or reschedule your appointment free of charge up to 2 hours before the appointment via the app
6.3.2If you cancelwith a notice period  of less than  2  hours before the appointment, you will be charged ,  the  entire amount
6.4In the unlikely event that a masseur  has to cancel your booking, we will:
6.4.1make our reasonable efforts to arrange for a replacement masseur to perform the  actin accordance with your originalbooking, as long as this is reasonable for you; or
6.4.2If no replacement masseur  is available, we will refund the money paid to us when booking your treatment back into your account.
7.Your rights to change your booking
If you would like to make a change to the massage  you have booked, please contact us via  support@massoon.nl..
We will let you know if your desired change is possible. If possible, we will notify you of any changes to the price of treatment, the time of delivery or any other changes that would be required and ask you to confirm whether you wish to proceed with the change. If we are unable to make the change or if the consequences of making the change are unacceptable to you, you must cancel or reschedule in accordance with our cancellation and rescheduling policy set out in Clause 6.3 (www. Massoon.net/cancellation).
8.Acceptable use
8.1You are responsible for your use of our  website and/or  app.. The Service is for your personal and non-commercial use and should only be used for informing or booking a Treatment.
8.2You agree not to attempt to contact a masseur  about the  treatment you have received for a period of six months after the date of such treatment, or to otherwise circumvent your relationship with us.
8.3When you use the website and/or  app or receivea  be-act, you agree that you are not:
8.3.1violate any of these conditions;
8.3.2violate, violate or appropriate the intellectual property, privacy, property or other legal rights of a third party;
8.3.3engage in inappropriate behavior that is offensive, intimidating, indecent, blasphemous, obscene, hateful or otherwise reprehensible, including but not limited to excessive drinking and sexual misconduct;
8.3.4to mislead others, create a fake account, or otherwise manipulate identification information to disguise the origin of material sent through the service, website, and/or app;
8.3.5collect information about others, collect data or otherwise, including email addresses, without their consent;
8.3.6upload, post, email or otherwise transmit material that constitutes unsolicited or unauthorized advertising, promotional material or any other form of invitation or commercial electronic message; Or
8.3.7engage with or encourage others to engage in criminal or unlawful conduct or violate these terms, including misuse of the service, website and/or app for unlawful or unauthorized purposes.
9.Property and copyright
9.1If you provide material to us through your account or otherwise (such as by posting a review, posting a therapist review, or uploading other content), you confirm that:
9.1.1your material is your own original work or you are authorized to provide it to us;
9.1.2all information provided by you to the website and/or app where, accurately, currently and completely;
9.1.3you are solely responsible for your material and use the Service, Website and/or at your own risk;
9.1.4your material is not defamatory, does not contain material that is harassing, threatening, obscene, abusive, hateful, offensive or inflammatory;
9.1.5your material does not take away the privacy rights, contract rights or other rights of another person and does not otherwise violate the laws of the country in which you are located;
9.1.6you have the right to give us permission to use it for all the purposes specified above and that such use does not infringe the copyright, database, trademark, privacy or other rights of a third party;
9.1.7your material is in no way susceptible to deception of others or otherwise harmful to or contrary to our good name or reputation;
9.1.8as far as you know, your material does not contain a virus or other code that may damage, disrupt, or otherwise adversely affect the operation of the Website and/or App; And
9.1.9your material does not contain any personal information from a third party, including but not limited to last name, address, phone number, email address and credit card number.
9.2By providing our material, you agree that you:
9.2.1grant us permission, irrevocably and free of charge, to use such material in any manner on a website or otherwise (including modifying and modifying for operational or editorial reasons) in all media worldwide, including possibly distributing the material to selected third party social media and networking sites; And
9.2.2waive all moral rights you may have on such materials
9.3If you consider the content of reviews, reviews, or other material posted by a customer on the Service to be offensive, discriminatory, defamatory, defamatory or otherwise inappropriate, please contact our Trust & Safety Team through support@massoon.nl  setting the details of the content you consider inappropriate and why you consider such content inappropriate.
9.4Upon receipt of a notice that a review is considered inappropriate in accordance with Clause 9.3, we will review such content and will at our discretion decide whether to remove such content from the Service.
9.5No content on the Service, Website and/or App may be construed as advice by us or to reflect our opinion or opinion. We do not give any warranty or statement regarding the accuracy, completeness, reliability or legality of information of opinions contained or expressed on the Service, Website and/or App.
9.6We are in no way responsible or liable for customer reviews or your trust in customer reviews.
10.Our rights to make changes to these terms and conditions

10.1We reserve the right to update these terms or to change or terminate the service at any time. Such amendments shall take effect on the effective date specified in the revised terms and conditions. If we change these terms and conditions, we will notify you by placing the revised terms and conditions on the applicable website and/or app and by sending you an email message to the email address you used when creating your account.
More important changes to the site and these conditions
10.2In addition, we may make more significant changes to these terms that may have a material or negative impact on your rights or the use of the service. In that case, we will notify you by email of these changes using the contact information you provided when creating your account. We reserve the right to ask your consent for the updated terms and conditions before continuing to use the Service.

Information about your legal rights
13.3If a booked Treatment is not performed with reasonable care and competence, you are entitled to your legal rights for inadequate service to the Therapist.
13.4With regard to a Booked Treatment, we inform you that you do not have a legal right of withdrawal in respect of distance agreements, as the agreement provides for a specific date or period for implementation.
14.Our responsibility for any loss or damage you have suffered
14.1We do not comment on the quality, safety or legality of either the therapists listed on the service, nor the treatments provided by the therapists. Although we require the therapists to ensure that their entry is truthful and accurate, we do not give any statements or assurances regarding the therapists and cannot confirm the accuracy of the entries or their content.
14.2You acknowledge that we are not liable to you for statements or statements made to you by a therapist as a result of your use of the Service.
We are responsible to you for typical and foreseeable damage caused by us
14.3If we do not comply with these terms, we are liable for any loss or damage you suffer that is foreseeable as a result of us breaking a contractual obligation to do so in any case of simple negligence that distinguishes the contract and on which you can rely (essential obligation).
We do not in any way exclude or limit our liability to you in any way if it is unlawful.
14.4Nothing in these terms restricts or excludes liability in relation to culpable damage to life, body or health, nor in cases of mandatory liability or that of our employees or agents. We are not responsible for any therapist or treatment, nor are therapists our agents.
Liability for damage to your property
14.5We are not liable for any damage to your property that arises as a result of your treatment. If a therapist provides treatment in your property, the therapist will reimburse any damage to your property in accordance with the terms and conditions under which you agree to the therapist’s treatment.
No liability for damage caused by unauthorized access.
14.6We are not responsible for any loss or damage sustained as a result of unauthorized access to your property  that is not within our reasonable control.
The site is not custom-made
14.7You acknowledge that the service, website, and app are not designed to meet your individual requirements and that it is therefore your responsibility to ensure that the facilities and features of the service, website, and app meet your requirements.
We are not liable for business losses
14.8We provide the Service only for domestic and private use. If you use the Service for commercial, business or resale purposes, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunities.
15.Other important terms
15. 1These terms and conditions constitute the full agreement between you and us regarding your use of the service, website and/or app. You acknowledge that you do not rely on any statement, promise or representation or insurance or guarantee that is not set out in these Terms.
15. 2These conditions are covered by Dutch  law and you can take legal action regarding the service, website and/or app in the competent  Dutch  courts. The choice of law does not affect your rights as a consumer according to the consumer protection rules of the country where you live.
